Priorities USA Action Files FEC Complaint Against Elon Musk-Backed “America PAC” for Violating Campaign Finance Rules

Facebook, YouTube, and X Ads Repurposing Trump Campaign Material 

PACs Cannot Republish Campaign Materials for Own Use

WASHINGTON, D.C. — Today, Priorities USA Action filed an FEC complaint against America PAC, the PAC supported by Elon Musk, for running ads on Facebook, YouTube, and X that consist almost entirely of repurposed Trump campaign material. America PAC has so far reported  $1,585,935.48 in independent expenditures on these ads.

Under Section 109.23 of Title 11, PACs cannot distribute or republish a campaign’s materials in their own political ads supporting that candidate except for use of a “brief quote.”

Priorities identified this violation via the Priorities-built competitive tracking tool, AdHawk. AdHawk monitors Republican and Democratic digital ad spending up and down the ballot, and is the only digital ad tracking platform that tracks spending, content, demographic and geographic targeting of digital ads.

“The new Elon Musk-backed PAC is breaking campaign finance rules to promote Donald Trump’s dangerous agenda to voters,” said Priorities USA Action Executive Director Danielle Butterfield. “This year’s campaign will be won and lost online, and we intend to refocus voters on the stakes of 2024 and hold Donald Trump and Elon accountable for any misleading and illegal activity. Priorities USA Action is taking the fight to Team Trump to aggressively beat him with every tool in our toolkit – from the law, to driving the conversation online to holding America PAC accountable.”

The FEC will send a notice to America PAC and may pursue enforcement.
